Attorney General Md Ruhul Quddus stated yesterday that the decision on the establishment of the Supreme Court Secretariat will ultimately be determined by the Appellate Division, as the government intends to challenge the High Court’s ruling. He emphasized that the High Court’s order to set up the Secretariat will remain on hold until the Appellate Division resolves the appeal. These comments were made by Ruhul during a press conference held at his office within the Supreme Court premises yesterday afternoon.
Ruhul informed journalists that the creation of a distinct Supreme Court Secretariat is intricately linked to the Supreme Court itself. He expressed confidence that the highest court will carefully hear and address the appeal to ensure that its future decisions are not called into question.
In response to a writ petition, the High Court bench, composed of Justice Ahmed Sohel and Justice Debashish Roy Chowdhury, issued a judgment on September 2 last year. The verdict nullified article 116 of the constitution, which granted the president the authority to oversee the control and discipline of lower court judges. The bench instructed the government to establish the Supreme Court Secretariat within three months and affirmed that the Supreme Court, rather than the president, would hold jurisdiction over the transfer, placement, and disciplinary actions concerning lower court judges.
